§ 1 LACON Mark The LACON GmbH mark has been registered with the German Patent Office under registration number 2025364 since 1992 (initially as a word/figurative mark, later as a trademark) and is protected against unauthorized use. It is also registered and protected as a Community Trademark with the Office for Harmonization in the Internal Market (Trademarks and Designs) in Alicante under number 002212132.

When used legitimately, the mark can be applied in two colors (green: HKS 57 N / black) as well as in black and white.

§ 2 Certification Mark The mark, together with the clear mention of the certification scope, becomes the certification mark. 

§ 3 Ownership of the Mark The owner of the mark or certification mark is LACON GmbH, Offenburg.

§ 4 Certificates and Documents The mark or certification mark is also used by LACON in certification certificates or other documents. The recipient of a certification certificate or other LACON document is entitled to use images of these documents for promotional purposes, as long as they are valid and have not been withdrawn or suspended.

A certificate holder has the option to use the certification mark on the labeling of their products. For this purpose, the certificate holder must have previously informed LACON of the intended manner of use and acknowledged these trademark regulations. LACON will then issue an informal approval for correct application (no violation of the certification standard or other legal regulations), but reserves the right to conduct separate inspections. Changes to the labeling of products containing the LACON mark, or the introduction of new products to be marked with the LACON mark, must be reported to LACON.

If not only individual products but the entire production of a company is certified by LACON, the certification mark may also be affixed in such a way that the labeling applies to the entire company (e.g., a farm sign for an agricultural operation), in accordance with the conditions mentioned above.

§ 6 Validity of Certification The use of the mark on the labeling of products designated by LACON is only permitted if the products are covered by the certification, valid control/certification contracts are in place, the certification is valid, and other labeling regulations (ordinances, laws) do not prohibit it. As soon as the certification for a product is no longer valid, the certification mark must be removed, in addition to complying with other legal provisions. This also applies to products that have already been marked and are intended for marketing.

§ 7 Violations In case of violations of these trademark regulations, LACON may demand from the user of the mark — irrespective of other sanctions required by the certification agreement / control agreement or, if applicable, by law — appropriate compensation for the expenses and damages (including reputational damage, if applicable) incurred by LACON.
